    Can My Ex Stop Me From Taking My Children To America? I have 2 children, age 7 and 15 to the same man. We were never married. His name is on the elder child’s birth certifiate, but not the youngest. I think I signed something the school sent out regarding the younger one giving him parental responsibility, a couple of years ago ( I reeeally wish I hadn’t, not sure of the implications of this). The boy’s dad sees them whenever he feels like it. We have been separated for over 6 years. My youngest is lucky if he sees his Father once every couple of months. He has never given me any money for child support. We have never been to court or had any legal court judgement over custody. My frustration has always been, I can’t take him to court to FORCE him to see his children. I started child support claim but stopped it when he started to give me £50 a week – this only lasted for about 4 months when he said he couldn’t give me any more money. He has been living about 15 minutes from his sons all these years in a big 4 bedroom house and has never made a bedroom for them, or a home for them, he has never wanted to incorporate them into his homelife. In the past 3 years he has moved in with his girlfriend and her son. They also live about 15 minutes up the road. My yougest has never been introduced to either of these people and my eldest has only met them by accident – when he saw another child in his Father’s van and questioned who it was. I have tried everything I know over the years to reason with him, threaten him, plead with him to see his children regularly but he has never agreed. he does what he wants when he wants and his children seem to come last after work, drink and his girlfriend and new family. I left him when our youngest was 6 months old because he was physically violent towards me. He hit me and subjected me to a half an hour of terror, at one point throwing me into our sleeping babies crib. He once dropped our new baby on the ground when he was 4 months old because he was drunk. He drinks a lot. When I left him he had a serious drink problem. I have, in the past year met a lovely man. He was an old friend, and has since returned to America where he is resident. We want to get married and I am going to America for the summer with the boys. We are planning to move there as soon as our fiancee visa comes through. The boys will instantly gain the same visa and ultimately green card status as me once we are married etc. I am going to see a family solicitor asap, but I am just wondering if anyone can give me some advice. I have no idea if he would try to stop me, he might. I think he is also signing on the dole and running a business, so legally he is on shaky ground. I have just completed my PhD and want to start a new life in the states with my fiance. Thank you.
